Product Recalls and Safety Notices

If we become aware that a product included in one of our kits is subject to a recall or market withdrawal, we reserve the right to remove the affected product from future kits, substitute a comparable product where appropriate, suspend sales of the affected kit, or otherwise take actions we deem appropriate to protect our customers and comply with applicable law. Because product recalls, market withdrawals, and safety alerts may occur after a kit has been shipped or delivered, Customer is responsible for reviewing any recall notices or safety communications issued by the FDA, the product manufacturer, or other applicable regulatory authorities before using any product contained in the kit. If a product included in a kit becomes subject to a recall, market withdrawal, or safety alert after shipment, Customer should immediately discontinue use of the affected product and follow the instructions provided in the applicable recall notice, including any instructions regarding disposal, return, replacement, or reimbursement. To the fullest extent permitted by applicable law, we shall not be liable for any injury, loss, damage, claim, or expense arising from or relating to the use, misuse, or continued use of a recalled product after the applicable recall, withdrawal, or safety notice has been publicly issued, provided that the recalled product was not subject to a recall at the time the kit was assembled and shipped by us.

 

Limitation of Liability
To the fullest extent permitted by applicable law, we disclaim liability for injuries or damages resulting from:
· misuse of any product;
· failure to follow the manufacturer's labeling or warnings;
· improper storage;
· use after the expiration date;
· use by individuals for whom the product is contraindicated;
· use inconsistent with applicable law or the manufacturer's instructions; or
· modifications or misuse of any product after delivery.
